Welcome to Max 80. These Terms of Service ("Terms") govern your use of our website located at max80.org (the "Site") and the services provided by Max 80 ("we," "us," or "our"). By accessing or using the Site, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the Site.

The Site may contain message boards, personal web pages or profiles, forums, bulletin boards, and other interactive features that allow users to post, submit, publish, display, or transmit to other users Content on or through the Site.

All User-Generated Content must comply with these Terms. You understand that we do not control, and are not responsible for, User-Generated Content, and that by using the Site, you may be exposed to User-Generated Content that you find offensive, objectionable, or otherwise inappropriate.

8. Monitoring and Enforcement

We have the right to:

Remove or refuse to post any User-Generated Content for any or no reason in our sole discretion.

You expressly agree that your use of the Site is at your sole risk.

10. Limitation of Liability

In no event shall Max 80, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the Site.

11. Indemnification

You agree to defend, indemnify, and hold harmless Max 80 and its licensee and licensors, and their employees, contractors, agents, officers, and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees), resulting from or arising out of your use and access of the Site, or a breach of these Terms.

12. Governing Law

These Terms shall be governed and construed in accordance with the laws of the United States, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

13. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
